- Nelson Muendo Nzyuko alias Kasavu is facing a murder charge contrary to section 203 as read with section 204 of the Penal Code.
- It is alleged that on 30/4/2024 at Kithuluni village, Kilungu Sub County, Makueni County he murdered Agnes Nzyuko.
- He pleaded not guilty on 29/5/2024. Bond was granted at Kshs. 200,000 with similar surety amount as there was no objection by DPP.
- To ensure that the bond terms were fair and within the accused’s reach – I sought a social inquiry report from PACs.
- The accused allegedly killed his maternal grandmother; the woman who raised him after his own mother abandoned him in her hands. As a result his maternal uncles – have rejected him and do not want to see him in that home.
- He has other siblings – but they were all born out of wedlock – and none of them has a home of their own in the village. His mother’s whereabouts are unknown.
- The area local administration believes that accused is not a flight risk – as he has lived well in the community.
- Despite these challenges, there are no compelling reasons to deny the accused bond and it is clear the bond terms awarded may be steep.
- The bond terms are revised to personal bond of Ksh. 100,000/= with surety of similar amount or two sureties each of Ksh 50,000.
- In the meantime, PACs could continue seeking out the accused person’s siblings. This order be served on PACs
- Orders accordingly.
