RULING
1. I have read the Bail report filed by the Probation officer. It indicates that the accused person has a previous conviction for murder and was released on Presidential pardon. Further that his immediate family are ready to stand surety for him.
2. The victim, the investigating officer and the community are apposed to his release on bond for reasons of his previous conviction and hostility towards him as well as fear of retaliation within the community.
3. However, in spite of the investigating officer stating his reservations about the release of the accused person on bond and even after learning of the previous conviction which the accused person readily conceded, there is no affidavit filed in opposing bond.
4. Learned counsel for the accused submits that the accused person is ready to be released on bond. If he is released, he will have to take care of his own security.
5. In view of his previous criminal conviction which is relevant and considering the seriousness of the charges, the accused person may be released on bond of KShs. 500,000/= with two sureties of a like same.
