1. The accused person is charged with Murder contrary to section 203 as read with section 204 of the Penal Code (Cap. 63), Laws of Kenya. The particulars of the offence being that the accused on 15th day November 2024 at Kwamwalani village of Kalamba location in Nzaui sub-county, within Makueni County murdered Muli Wambua.
2. After he took the prosecution told the court that there was no objection to bond.
3. The accused was admitted to bond of Kshs. 300,000/= with similar surety amount. I nevertheless directed Probation After Care Services is to avail a Social Inquiry Report in the event that these bond terms were on the higher side for the accused person and any other concerns
4. When the report was filed it was indicated under the Victim(s) Brief & Victim’s Family Concerns heading that the deceased family is distant neighbour and distant relative to the accused family. And that during the inquiry the victim’s family stated that they were not comfortable seeing the accused out on bond until compensation of their son is done.
5. Regarding other the issues: The accused’s family and the DCI Nzaui noted there was no risk of the accused interfering with witnesses in any way; According to the area assistant chief Kalamba and the family members, the accused is not a flight risk because of his residential stability at Kalamba area in Nzaui, he has been a peaceful and law abiding citizen before this with positive family and community ties.
6. The family is ready to seek a surety because their own land does not have a title deed. The accused has three siblings all of whom have their families, he is a husband, a father and a grandfather.
7. It is his request that his bond be reviewed downwards.
8. From the foregoing it is reviewed to Ksh 200,000 with a surety of the same amount.
9. Orders accordingly
