REPUBLIC…………………………………………………PROSECUTOR
-VERSUS-
ELIZABETH WANJIKU MWANGI……………………RESPONDENT
RULING
1. The accused herein ELIZABETH WANJIKU MWANGI faces a charge of Murder. She prays to be released on bond during the pendency of her trial. The right to bond is enshrined in Article 49(1) (h) of the Constitution of Kenya 2010 .
2. I have considered the Pre-bail report filed in court on 10 th February 2026 . The same is favourable. I note that the ODPP does not object to the release of the Accused on bail. There are no factors which would indicate that the accused is a flight risk.
3. In conclusion I find no compelling reason to deny the accused bail and accordingly I admit the accused to bail in the amount of Kshs. 1.0 million + 1 surety of a similar amount . It is so ordered.
Dated in Nyeri this 13 th day of February 2026.
