RULING

1. The application dated 04.04.2025 will be heard by way of written submissions.
2. The Plaintiff/Applicant is directed to prepare, file and serve their submissions on the application within 30 days from today’s date.
3. The Defendant/Respondent is directed to prepare, file and serve the submissions in opposition to the application within 30 days from the date of service.
4. The application dated 04.04.2025 mentioned on 19.09.2025 to confirm compliance and fix a ruling date.
5. In the meantime, a temporary injunction be and is hereby issued against the Defendant/Respondent prohibiting them in person or through their agents, servants and employees from interfering with the use, occupation and ownership of the property known as ELDORET MUNICIPALITY BLOCK 14/1518 pending the hearing and determination of the present application.
6. The County Land Registrar and the County Land Surveyor are directed to visit the property known as ELDORET MUNICIPALITY BLOCK 14/1518 and re-establish its boundaries and the person in occupation of the same within 60 days from today’s date.
7. The costs of the site visit will be shared equally between the Plaintiff /Applicant and the Defendants/Respondents.
