I have considered the Appellant’s application that the appeal be dismissed for non-compliance. I have also considered the submissions. I note that certified proceedings have not yet been availed. Consequently, we cannot fully blame the Appellant for the delay.

Nevertheless, the Appellant must be proactive. I will in the circumstances not dismiss the appeal as is sought. I make the following orders:

  1. Appellant to file and serve Record of Appeal and written submissions within 45 (Forty Five) days from today. Certified proceedings need not be included in the record if they will not be ready by then.
  2. Respondent to file and serve written submissions within 30 (Thirty) days of service.
  3. The Deputy Registrar to obtain typed and certified proceedings together with the record of the Subordinate Court.
  4. Mention on 23rd January 2025 for further directions.
