RULING

1. The matter involves a commercial dispute emanating from a loan Agreement between the parties.
2. The issue of how much is outstanding and/or the compliance of the loan facility is a commercial issue.
3. Consequently, this file is hereby transferred to the High Court for further direction.
4. The Deputy Registrar is directed to transfer this file to the Presiding Judge of the High Court in Eldoret for further directions.
5. In the meantime, the order issued on 19.05.2025 be and is hereby discharged forthwith.
6. The matter will be mentioned on 05.06.2025 before the Presiding Judge High Court – Eldoret.
