Prof. Tom Ojienda & Associates VS The National Land Commission

High Court at Milimani High Court · · Githiru Freda Mugambi

1. Before me is an application for entry of judgment filed by the advocates. It is dated 5/2/2024 and was served upon the respondent. I note that Ms. Njuguna appearing for the respondents was allowed 21 days to file a response to the said application during the Court appearance of 11/7/2024.

2. When the matter came up again on 1/10/2024, Ms. Msando for the applicant confirmed that they had complied with this Court’s orders but Ms. Njuguna sought a further 14 days to file their response to the application and written submissions. The Court again allowed the respondents an opportunity. The matter came up for hearing on 18/11/2024 and again no response had been filed. The respondents were also absent. I assume that the respondents have no objection to raise and that the application is unopposed.

3. Consequently, having considered the application in light of the Certificate of Taxation and the ruling on taxation, judgment be and is hereby entered in terms of the application dated 5/2/2024.  Accordingly, file is hereby marked as closed.

DATED, SIGNED AND DELIVERED IN NAIROBI
THIS 18TH DAY OF NOVEMBER 2024.
