1. Before this Court for determination is the Notice of Motion dated 14th January 2026. The Applicant, Prof. Tom Ojienda & Associates, seeks orders for the entry of judgment against the Respondent, the County Government of Nairobi, for the sum of Kshs. 58,770,228.39 as certified by the taxing master.
2. The Applicant further prays for interest on the said sum to be calculated from one month after the date of service of the Bill of Costs (from 21st August 202) until payment in full, and for the costs of this application.
3. This matter emanates from legal services rendered by the Applicant to the Respondent in HCCOMM Civil Case No. 421 of 2013, Hausram Limited vs Nairobi City County. Following the conclusion of the matter, an Advocate-Client Bill of Costs dated 16th June 2025 was filed.
4. The Bill was taxed on 21st November 2025, resulting in a cumulative sum of Kshs. 58,770,228.39. A Certificate of Taxation was subsequently issued by the Deputy Registrar on 3rd December 2025. The Applicant contends that this certificate remains valid, has not been set aside, and the Respondent has failed to settle the certified fees.
5. When the matter came up for hearing, Mr. Cheruiyot, learned Counsel appearing for the Respondent, informed the Court that the Respondent had no objection to the application. Counsel formally conceded to the prayers sought in the Notice of Motion, acknowledging the existence of the Certificate of Taxation and the absence of any pending reference or stay of the same.
6. In light of the concession by the Respondent’s Counsel and the evidence presented, including the Bill of Costs (PTO-1), the Taxation Ruling (PTO-2), and the Certificate of Taxation (PTO-3)—there is no dispute for this Court to adjudicate upon.
7. Under Section 51(2) of the Advocates Act, where a Certificate of Taxation has been issued and remains unchallenged, the Court is empowered to enter judgment accordingly. Given that the Respondent has conceded to the application, the Applicant is entitled to the orders sought.
8. Consequently, I make the following orders:
i. Judgment is hereby entered for the Applicant against the Respondent for the sum of Kshs. 58,770,228.39.
ii. Interest shall accrue on the said sum at court rates from 21st August 2025 until payment in full.
iii. The costs of this application are awarded to the Applicant.
9. It is so ordered.
