PRISKA KWAMBOKA MARANGA AND PIUS MARANGA NYAKUNDI VS NYAMIRA COUNTY LAND REGISTRAR AND JOSEPHINE MORAA ORUCHO AND 9 Others

Environment and Land Court at Nyamira Environment and Land Court · · Dalmas Ohungo

I have considered the 2nd to 11th Defendants’ application for adjournment and the submissions.

The record shows that on 18th March 2026, the 2nd to 11th Defendants sought time and were given 14 (fourteen) days to file and serve compliance documents.

On 20th April 2026, Mr Omwoyo yet again sought 7 (seven) days to file and serve compliance documents. He stated that he had been bereaved. Bereavement is cited in support of today’s application for adjournment.

Between 18th March 2026 and today, the 2nd to 11th Defendants have had over two and a half months. No valid explanation has been offered as to failure to comply within that extended period. Bereavement cannot justify non-compliance over that long duration.

In the ruling delivered on 18th March 2026, the Court expressly ordered that parties expeditiously prosecute the suit. Today’s date was taken by consent.

I find no merit in the application for adjournment. I dismiss it. Hearing to proceed at 11.45 am.

Dated this 3rd day of June 2026.
