PRINTING SERVICES LIMITED VS JOMO KENYATTA FOUNDATION AND CABINET SECRETARY,MINISTRY OF EDUCATION AND 1 Others

High Court at Milimani High Court · · R. E. Aburili

I have considered the application dated 02/04/2025 under certificate. I have read the grounds, the statutory statement and verifying affidavit together with annexures. I find no urgency involved. I decline to certify it as urgent. On whether leave should be granted to apply for Judicial Review orders are sough, having perused the documents annexed, including the correspondence between the parties, I am unable to accept that this is a Judicial Review matter. An acknowledgement of a debt for printing services does not amount to a decree of the court capable of being executed or enforced by this court by way of Judicial Review proceedings. The applicant is in a wrong forum seeking for summary Judgment on a liquidated sum and for the court to determine a civil claim which matter falls in the Jurisdiction of an ordinary civil or commercial court.

I decline to grant leave to apply and dismiss the application dated 02nd April 2025.
