In view of the order of Mugambi J. dated 27.06.2023 granting orders of status quo in respect of the Plaintiff’s application dated 21.06.2023 and bearing in mind that the Plaintiff's properties charged to the Defendant are due for auction today, 19.07.2023, I hereby direct as follows:
1. The Defendant is restrained from selling or otherwise disposing of the properties Kajiado/Kipeto/11213, 5677, 21575 and 254 pending further orders of this court on conditions hereunder.
2. The Plaintiff shall deposit Kshs. 1,000,000.00 in court by the close of business on 21.07.2023 and pay the Defendant costs of Kshs. 50,000.00. In default of compliance, the orders in place shall lapse.
3. The matter shall be mentioned on 24.07.2023 for further directions and orders.
