The Defendant states that it only owes Kshs. 500,00.00 but the Plaintiff claims that it is owed Kshs. 1,590,000.00. The amount held by the Garnishee is Kshs. 1,050,000.00.
Since there is an undisputed debt of Kshs. 500,000.00, the application dated dated 20.12.2023 is allowed and the Garnishee order nisi is made absolute only to the extent of Kshs. 500,000.00 which shall be paid to the Plaintiff forthwith.
The balance of the claim is placed before the DR to determine the extent of indebtedness. In the meantime, the Garnishee Order Nisi shall remain in force pending the determination of the amount due.
Mention on 16.03.2023 before the DR for determination of the amount outstanding before the orders is made absolute. Costs in the cause.
