RULING
- The Application dated 20/03/2024 seeking for stay pending Appeal by the Appellant/Applicant is hereby compromised by consent in the following manner:-
- An order of status quo be and is hereby issued on the property known as L.R NO. TRANSMARA/SHARTUKA/256 pending the hearing and determination of the Appeal before this court.
- For avoidance of doubt, the Appellants, their agents and/or employees are hereby prohibited from constructing any new structure, either temporarily or permanent and further are directed to plant any new crops and/or trees but are allowed to keep any crops that are already planted until the same are harvested.
- The Appellants are directed to deposit a sum of Kshs.400,000/= as security for costs within 30 days from today’s date in court failure to which the status quo shall be vacated and/or lifted and the Respondent will be at liberty to execute.
