Ruling On Sentence
1. The appellant's appeal on conviction was dismissed.
2. in his appeal he had sought the review of his sentence to a non custodial sentence
3. I sought a pre sentence report.
5. I considered the report and the nature of the offence. It was proposed that since the incarceration of the accused person the home where he lived with the victim has been abandoned as no one lives there as both their parents are dead.
The victim, who has a mental disability has almost no one to care for her in his absence.
However she has a married sister.
The appellant abused his position of the caregiver and must go through some punishment for the same so as to understand the weight of the same.
6 I was of the view that a non custodial sentence would not be suitable though he is a first offender.
7 The appeal on sentence is is allowed to the extent only that the sentence meted by the subordinate court is revised from 14 years' imprisonment to 7 years imprisonment with effect from 14th August 2021, the date of arrest .
8 Orders accordingly
