High Court at Bungoma High Court · · M.S.Shariff

Ruling
1. Upon the Appellants' Notice of Motion dated 9.12.2025 coming up for hearing before me this 9.12,2025 ex parte for orders of certification as urgent and for grant of interim order of stay of execution of the judgment entered in Webuye MCC No 133 of 2018, I have duly considered the application herein, the affidavit sworn by Patrick Waweru Kamau on even date and the enclosures attached thereto and I note that proclamation was done way back in August 2025 and there is imminent risk of execution, wherefore I do find that urgency has been demonstrated. I thus make the following orders :-
i) This application is certified as urgent.
ii) The same be served within 2 days and a response be filed and served within 6 days from the date hereof.
iii) Inter Partes hearing is scheduled on 16th December 2025 by way of oral submissions.
iv) An order of interim stay of execution of the judgment delivered in Webuye MCCC 133/2018 is hereby granted until 16th December 2025.

Delivered, Signed and Dated this 9th day of December 2025
