RULING
1. I have looked at the Applicant’s Notice of Motion application dated 22 nd April 2026 and filed on 23 rd April 2026 and the Supporting Affidavit of Julius Orenge that was sworn on 22 nd April 2026 and the enclosures therein and have noted that the same was served upon the Respondent as was evidenced in the Affidavit of Service of Julius Orenge that was sworn and filed on 29/4/2026. However, the Respondent has not filed any response thereto and as at 11.01 am is not present in court either virtually or physically. The said application is technically unopposed.
DISPOSITION
2. Accordingly, having heard the Applicant’s counsel, I hereby allow the Notice of Motion application dated 22 nd April 2026 and filed on 23 rd April 2026 in terms of Prayer Nos (2), (4) and (5) therein.
3. The Respondent will bear the Applicant’s costs of this application.
4. Orders accordingly.
