1. The Application for determination is the Notice of Motion dated 27th February 2026, which is expressed to be brought under the provision of Section 1A, 1B and 3A of the Civil Procedure Act, and Section 51 (2) of the Advocates Act. It seeks for orders that this Court be pleased to enter Judgment in favour of the Applicant against the Respondent in the sum of Kshs.106,649.60/= being the amount certified in the Certificate of Costs issued on 23rd February 2026; together with interest at Court rates. The Applicant has also prayed for costs of the Application to be provided for.
2. This application which is not opposed is supported by grounds on the face of it and the supporting affidavit of Robert Ongeri Advocate, sworn on 27th February 2026 and the annextures thereto.
3. An Advocate-Client Bill of Costs was taxed in favour of the Applicant on 24th October 2025. A ruling to that effect is attached to the supporting affidavit.
4. On 23rd February 2026, a Certificate of Taxation was issued.
5. The Applicant contends that there is no reference filed challenging the taxation and in any event the time for filing such reference has lapsed. The Certificate of Taxation has not been set aside or altered by this Court.
6. Having considered the application in light of the grounds relied upon and the Affidavit evidence can record, it is my view that the same is merited.
7. Consequently, the Application is allowed. This court therefore enters Judgment for the Applicant against the Respondent in the sum of Kshs.106,649.60/= in terms of the contents of the Certificate of Costs issued on 23rd February 2026, plus interest at Court rates from the date of taxation. The Applicant is also awarded costs of this application.
This matter is therefore marked as closed.
