'I have looked at the Applicant''s Ex parte Chamber Summons application dated and filed on 14th November 2025 and the Supporting Affidavit of Dr Martin Oloo that was sworn on even date and the enclosures therein and have noted that the Applicant has today, 17th November 2025 filed a Notice of Withdrawal of even date seeking to wholly withdraw what it has referred to as a Notice of Motion application dated and filed on 14th November 2025. The only application that is on the file is an Ex parte Chamber Summons application dated and filed on 14th November 2025. To avoid prolonging this matter and noting that there are no nearer dates and further guided by Article 159(2) (d) of the Constitution of Kenya, 2010 that mandates courts to administer justice without undue regard to technicalities, I hereby take judicial notice that the Applicant wishes to withdraw the said Ex parte Chamber Summons application dated and filed on 14th November 2025. Accordingly, I hereby direct that the Applicant''s Ex parte Chamber Summons application dated and filed on 14th November 2025 be and is hereby withdrawn and marked as withdrawn with no order as to costs. File to be closed forthwith. Orders accordingly.  '
