1. The Notice of Motion dated 13th April 2026 seeks to stay proceedings in this petition pending the delvery of the judgment in Milimani HCCHR Petition No. E335 of 2025; Michael Makubo William V. The National Transport and Safety Authority & 3 Others , on the grounds, inter alia, that petitioners in both matters are challenging the regulation of the use of graffiti on Public Service Vehicles by the National Transport and Safety Authority, pursuant to Regulation 7 of the National Transport and Safety Authority (Operation of Public Service Vehicles) Regulations, 2014, that both said petitions are before the High Court, and that the Advocate on record in this petition is also the Advocate on record in Petition No. E335 of 2025.
2. I note that the Petition No E335 of 2025 has been slated for delivery of judgment by his lordship, the Honourable Mr Justice Bahati Mwamuye, MBS, on 29th April 2025. This matter, on its part, is due for mention before me on 4th May 2026 to confirm compliance with the prior directions and for further orders. That being the case, by the time this matter is mentioned on 4th May 2026, the judgment in E335 of 2025 will have been delivered. The possibility of two conflicting decisions does not appear likely to me. In the circumstances, I am unable to certify the Notice of Motion dated 13th April 2026 as urgent, nor to issue any interim orders as sought.
3. I therefore direct that the said Motion be served upon all the parties within three working days of the date hereof and that an affidavit of service evidencing such service be filed within one day thereafter. The matter will be mentioned on 4th May 2026 for further directions as earlier scheduled.
4. It is so ordered.
