There is judgment in favour of the Applicant against the Respondent. In the application dated 17.05.2023, the Respondent seeks to be allowed to liquidate the decretal sum by installments. I have heard the respective proposals by the advocates who have been unable to agree on terms.
The application is allowed on terms that the Applicant shall pay the decretal amount as follows:
1. Kshs. 400,000 within the next 14 days from the date hereof.
2. The balance of the decretal sum shall be paid in equal monthly instalment over a period of 8 months commencing on or before 6th July 2023 and payable on the 6th day of every subsequent month.
3. In default of any one installment, the full amount shall become due and the Applicant shall be at liberty to proceed with execution.
4. Costs of the application shall be borne by the Respondent and are assessed a Kshs. 10,000.00.
