RULING

  1. The matter was picked up by the court during the service weeks of the year 2023 and 2024.
  2. The court managed to proceed with the Plaintiff case.
  3. However, the Plaintiff upon changing advocates sought to re-open the Plaintiff case.
  4. The court directed the matter to be heard on 26.05.2025 and 27.05.2025.
  5. However, today some parties were not ready to proceed.
  6. Keeping in mind that this is a Nairobi matter the essence of the service week was to expeditiously conclude the matter.
  7. However, it seems the file will require more time to be dealt with.
  8. It is only fair that the file be returned to Nairobi for further hearing and determination.
  9. To this effect, this court makes an order that the file be placed before the Principal Judge ELC on 24.06.2025 for further directions in terms of re-allocating the same to a judge in Nairobi.
  10. The Deputy Registrar – ELC is directed to ensure the file is transmitted to the office of Presiding Judge for further hearing.
