I have had occasion to consider the application dated 17th January 2023. From the disclosed facts, i note the application challenges by way of judicial review judicial proceedings before the Chief Magistrates Court. That Court like all subordinate courts and Tribunals is certainly under the supervisory jurisdiction of this court in so far as propriety of the proceedings are concerned.
Having had due regard to the issues raised, i am of the view that the question whether leave sought be granted, and if granted, whether the same is to operate as a stay be canvassed inter partes.
I direct that the chamber summons be served. Responses be filed within 7 days of service. The matter be disposed of by way of written submissions. The applicant to file submissions within 7 days of service of responses and the Respondent and Interested Parties to file within 7 days of service of rival submissions.
