In the application dated 03.02.2023, the Advocates seek judgment on a Certificate of Costs under section 52 of the Advocates Act. Counsel for the Respondent/Client did not oppose the application save for the issue of interest. There is no reason to disallow interest from the date of taxation as the Client had the opportunity to pay the amount once the costs were ascertained.
The application is therefore allowed on terms that Judgment be and is hereby entered for Advocates against the Client for the sum of Kshs. 3,668.750.00 together with interest at 14% p. a. from 09.09.2022 until payment in full. The Respondent shall bear costs of the application assessed at Kshs. 15,000.00.
