The Appellant in the application dated 17.03.2023 seeks stay of execution. I have considered the arguments by the parties. The application is allowed on the following terms:
(a) The sum of Kshs. 750,000.00 shall be deposited in a joint account in the names both advocates within 14 days from the date hereof failing which in court.
(b) In default of the above order, the Respondent shall be at liberty to proceed with execution.
(c) The stay shall remain in force for a period of 6 months unless extended by this court.
(d) Mention on 19.05.2023 for directions on the appeal.
