In the application dated 10.03.2023, the Judgment Debtor seeks stay of execution on the ground that the goods attached belong to a third party. The third party has not filed an objection to the attachment. The Judgment Debtor cannot purport to litigate on its behalf of an objector in view of the existence of the provision of Order 22 rule 54 of the Civil Procedure Rules which allow an objector to lodge proceeding in its own right. The application is dismissed with costs assessed at Kshs. 5,000.00 to be paid by the Judgment Debtor.
