1. Before me is an application dated 4th December, 2023. I note that the matter came up before court on 4th June, 2024 and again on 15th July, 2024 when the court directed that the application be served for a second time and responded to within 14 days.
2. I have seen the affidavit of service sworn on 14th February, 2024 and I am satisfied that the application was served on the respondent in the manner averred.
3. In absence of any response from the respondent and having considered the same, the court takes it that the application is not opposed. The same is therefore allowed as prayed and consequently, judgment is hereby entered for the applicant against the respondent for the sum of KShs.430,683/- in costs certified by the Deputy Registrar on 19th October, 2023 with interest at the rate of 14% pa from 28th October, 2021 until payment in full.
4. The applicants shall have the costs of the application.
