i have considered the Ex-Parte chamber summons dated 4th November 2024 together with the statement of facts and the verifying affidavit. I have also read all the the annextures attached to the verifying affidavit.
The applicant seeks this court's leave to institute judicial review proceedings for an order of mandamus on grounds that the respondent has refused to satisfy a decree issued in his favour in Murang'a Chief Magistrate's Court Civil Suit No. 100 of 2020. The annextures to the verifying affidavit reveals that there is indeed a decree in the sum of Kshs. 453,000 which was issued by the lower court in favour of the applicant on 21st February 2024.
In the premises, i am satisfied that the applicant has an arguable case against the respondent. I consequently allow the application and grant the applicant leave as prayed on terms that he files and serves the substantive motion within the next 21 days.
