This ruling is in respect of the Notice of Motion application dated 9th July, 2025 expressed to be brought pursuant to the provisions of sections 1, 1A, 3 and 3A of the Civil Procedure Act.
The substantive relief sought is for an order that the court authorizes the Deputy Registrar of the court to sign the transfer forms in respect of Land parcel No. KISUMU/KARATENG/884 so as the land can be transferred to the Plaintiff in line with the Judgement of the court delivered on 25th May, 2023. The application was unopposed.
I have read and considered the grounds of the application. The judgement of this court dated 25th May 2023, a copy of which is attached to the application, directed the Defendant as the personal representative of the deceased to, inter alia, transfer land parcel No. KISUMU/KARATENG/884 to the Plaintiff forthwith in default of which the Deputy Registrar of the court was authorized to sign all documents necessary for the transfer of the land in favour of the Plaintiff.
The order sought herein was therefore already granted in the Judgement and decree.
Be that as it may, the application is allowed. No order as to costs.
Orders accordingly.
