I have received the sentence review report filed herein in respect of Muruche Kamanza Muruche from the Probation and Aftercare Service Department dated 9/10/2024 as per this court’s directions dated 19/9/2024 requesting for the same.
I have perused the trial court file and I note that the 2nd offender Muruche is the only one remaining in custody after the 3rd offender Chirima Hamisi Mwingo was released on 15/5/2024 by this court on review of sentence to serve community service. They had been convicted and sentenced together on 20/11/2023.
The sentence review report indicates that he is suitable for a non-custodial sentence. Consequently, this court now directs that the 2nd offender’s remaining term of imprisonment is reviewed and substituted with a commitment for him to serve community service for 3 months at Portreitz Chief’s office. He shall be released to the Mombasa Probation and Aftercare department to undertake the sentence.
Consequently, this file is closed.
