The Notice of motion dated 27th September 2024 is not opposed by the Respondents. The applicant has raised issues that touch on personal safety and liberty. It is not a matter that this court would take lightly since the allegations by the applicant appear grave in nature.
The Right to the protection of the law under Article 27 of the Constitution is sacrosanct and all persons must be allowed to live freely without fear of arrest which greatly inhibits one from exercising his other freedoms and rights. The applicant shall therefore execute a personal bond of Ksh. 100,000/= and a restraining order shall consequently issue against the Respondents barring them from arbitrarily arresting the applicant. The Respondents are however at liberty to summon the Applicant for purposes of any investigation and should a decision be reached that he is to face Criminal Charges he shall be summoned by the police to appear in court on a date to
be specifically mentioned on the face of the summons.
It is so ordered.
