The application for stay dated 9th Feb 2026 has been considered together with the replying affidavit. The parties are both litigants in person and no submissions were filed.
Having heard the parties, and considered the material before the court, I find that there is no basis to grant the application for stay. The matter was before the lower court, and a decree was issued in July 2024. A notice to show cause was issued following default of payment in respect of the applicant. To date the applicant has not made the support related payments pursuant to the decree.
The applicant filed his appeal and application for stay only after the lower court issued a notice to show cause and found that no sufficient cause had been shown.
In my view the requirements of order 42 rule 6 has not been met. The applicant did not demonstrate the substantial loss he is likely to suffer if the stay is not granted.
The application for stay is declined. The application is dismissed with costs.
