Upon considering the petitioner dated 22/10/2024, the affidavit in support thereof sworn by Millicent Anyango Agutu on even date and ennexures thereto, I do hereby note that the petitioner is guilty of laches where no urgency has been demonstrated. Further the petitioner has filed a petition and not a summon for revocation of grant as envisage under Rule 44 (1) of the probate and administration Rules and Form 107. Wherefore I do hereby strike out the petition herein with no orders as to costs.
