I have considered the notice of motion dated 25th March 2025 in chambers in the absence of the counsels for the parties.
I am not persuaded that grounds warranting the setting aside of the orders I issued this morning have been disclosed in the said motion. The orders I made this morning were grounded on the arguable point that the court below issued orders that were not grounded on the pleadings and were thus in vacuo. This latter point is not idle; it deserves to be interrogated during the interparties hearing and determined on its merits. The court also perused the documents filed together with the earlier application and was persuaded that Annual General Meetings are required to be held, under the rules, before the end of March of any given year.
In the circumstances, I certify the application urgent and order that the same be heard on 8th April 2025.
