Ruling
Upon Reading the Certificate of urgency, Notice of motion Supporting affidavit by Jenifer Slovea all evenly dated 10th July 2024 I am inclined to order and direct as follows
- The Application is certified as urgent meriting hearing and determination exparte in the 1st instance
A conditional Order for stay of execution pending the appeal is hereby issued on condition that, the Applicant pays half of the decretal sum of Kshs 563,285.50 to the Respondent and furnishes either an insurance bond or a banker’s bond from an institution of repute within Thirty (30) days from the date of this Directions and
A default in compliance the condition(s) set shall automatically vacate the stay orders granted and the Application shall be deemed to have been dismissed with costs.
The Application dated 10th July 2024 is hereby marked as spent.
