The application dated 24.03.2023 is for stay pending appeal. Counsel for the Respondent does not object to it in principle. It is allowed and an order of stay is issued on terms the Appellant shall deposit the sum of Kshs. 480,000.00 in a joint account to be agreed by the parties within 14 days and failing such agreement deposit the money in court.
In default of compliance, the order of stay shall lapse. In the event of compliance, the order shall remain in force for one year unless otherwise extended by this court.
Mention on 27.04.2023 for directions on the appeal.
