RULING
1. Based on the Supporting Affidavit attached to the Application dated 6.05.2026 and the Replying Affidavit dated 12.05.2026, this Court is persuaded that the Plaintiff has a prim facie case and requires to be granted the orders sought therein.
2. Consequently, a temporary injunction be and is hereby granted prohibiting the Defendant known as Robert Sike and/or the former owner Richard Kipruto Busienei or their agents, servants, employees or any other person deriving their rights from these two persons from entering, cultivating, erecting any structure, developing and/or in any manner whatsoever interfering with the quite occupation and use by the planting over the suit property known as L.R Chepterit/Cheplaskei Block 2(Chepkigen) 251 pending the hearing and determination of this suit.
3. The OCS Cheptiret Police Station is directed to ensure compliance of this order upon service.
