I have considered the applicant's application dated 6 June 2024 filed under a certificate of urgency of even date. Considering that the decision complained of was made way back in October 2023, I am not satisfied that this application is urgent. Nonetheless, leave is granted in terms of prayers 2, 3 and 4 of the chamber summons. The prayer for leave to operate as stay is declined. Since the applicant is seeking the quashing of the decision upon which she is called upon to mitigate, it is not necessary that the mitigation is stayed. If the decision is ultimately quashed, any proceedings subsequent to the decision, including the anticipated mitigation, will be rendered inconsequential.
As far as the filing of the main motion is concerned, I direct that it to be filed and served within 7 days of the date of this ruling. The respondent is directed to file and serve its response to the motion within 7 days of the date of service of the applicant's motion. The motion shall be mentioned on 25 June 2024 for purposes of taking directions on the model of its disposal. It is so ordered.
