This matter is before me for purposes of revision under the decongestion exercise by the Judiciary vide memo dated 13th March 2024.
The offender was sentenced to pay fine of Ksh 100,000 i default to serve 2 years' imprisonment for causing death by dangerous driving, ksh 10,000 in default 3 months imprisonment, for riding a m/cycle on a public road without insurance.
The Probation Officer recommends probation for 2 years and 2 months.
The maximum default penalty for a fine exceeding 50,000 is one year.
The recommendation for Probation is rejected.
The sentence is however revised to fine of ksh 100,000 in default 12 months imprisonment
and Ksh 10,000 in default 3 months imprisonment
