MAJOR SULEIMAN KANYANYA SUMBA AND ABDALLA OWOUTSI VS State Law AND Cabinet Secretary Interior and Cordination of National Govt.

Environment and Land Court at Kakamega Environment and Land Court · · Dalmas Ohungo

I have considered Mr Mandala's application for interim orders and submissions of counsels. I note that the petition concerns several parcels of land and from the material on record, it is not demonstrated that all affected property owners and interested parties have been given a chance to be heard. I am not persuaded that it is appropriate in the circumstances to grant any interim orders as is sought. I will not grant any.

To enable the intended interested party to formally join the matter and for the respondents to file a response, I make the following orders:

  1. Mrs Chunge's clients to file and serve a formal application to join the matter within 3 (three) days from today.
  2. Respondents to file and serve a response to the petition and to the Notice of Motion within 7 (seven) days from today.
  3. Mention on 26th June 2024 for further directions.
