RULING
1. The matter was coming up for hearing of the Application dated 07.11.2025.
2. The Application was opposed.
3. However, this is a Nairobi matter that the Court was handling during its service weeks.
4. The parties elected to proceed with the matter in Eldoret to expedient completion of the same.
5. Indeed, all parties attended Court in Eldoret and matter proceeded as agreed.
6. However, despite the 2nd Defendant attending Court and testifying in Nairobi, there is now difficulty for them to attend Court in Eldoret when the last witness is to testify.
7. Consequently, the file is hereby referred to the Presiding Judge to give directions whether or not this Court should complete the last witness while sitting in Eldoret or the file will be allocated to another Judge in Nairobi.
8. As such the file will be mentioned before the Presiding Judge Environment and Land Court in Milimani on the 29.01.2026
