High Court at Milimani High Court · · Kanyi Kimondo

1. The applicant was convicted of manslaughter under a plea agreement recorded on 7 th December 2025 in Nairobi HCCRC No. 45 of 2019. She was subsequently sentenced to 12 years’ imprisonment and granted full credit for the period spent in remand custody.

2. The applicant has now returned to the High Court by way of Notice of Motion dated 11 th November 2026 seeking review of the sentence into a non-custodial sentence or for grant of a probation order for the reasons set out at length in her affidavit sworn on even date.

3. By dint of section 137 (L) of the Criminal Procedure Code , the sentence delivered by the High Court was final as well explained to the applicant before he entered into the plea agreement. The only recourse open to the applicant for review is an appeal to the Court of Appeal regarding the severity of the sentence.

4. The upshot is that the High Court has no jurisdiction to review any aspect of the sentence. The Notice of Motion is accordingly dismissed.
