1. The Application dated 3rd December 2024 though unopposed was heard on its merits. The Applicants submit that there is a good basis for seeking stay of proceedings as the consolidated matters before the Chief Magistrate’s court involve different parcels of numbers and different parties.
2. Having considered the Application, the court returns a finding that the same is merited and the same is allowed in terms that there be a stay of proceedings in Kilgoris CMELC Case No. E096/2023 the lead file after Consolidation of Kilgoris ELC Case No. E096/2023 and Kilgoris CMELC No. E099/2023 pending hearing and determination of the Appeal.
3. Costs of the Application be in the cause.
