This matter was coming up today for Hearing of the Petitioner/Applicant's Notice of Motion Application dated 21/06/2024. BY CONSENT OF THE PARTIES, Prayer 3 of the Notice of Motion Application dated 21/06/20 is allowed as prayed and shall operate as an Order of this Court, and the Petitioner/Applicant has withdrawn the remainder of the prayers in the said Application, rendering the said Application as fully determined and closed. The Parties, by consent, now progress the matter to the hearing and determination of the Petion.
The Resulting Order is as follows:
ORDER - 17/07/2024
1. By Consent of the Parties, Pending the Hearing and Determination of this Petion, the Respondent be and is hereby stopped from taking any steps to collect any money pursuant to the Demand Letter dated 16 August 2023, is stopped from issuing any Agency Notice to the Petitioner/Applicant's bankers or debtors with respect to the subject matter of the Petition, and is stopped from progressing with the enforcement of any existing agency notices covering the subject matter of the Petition and shall withdraw any that exist.
2. By Consent of the Parties, and with Prayer 3 of the Notice of Motion Application dated 21/06/2024 having been granted by consent, the remaining prayers of the Application are withdrawn by the Petitioner/Applicant and the Application is thus fully determined and closed.
3. The Respondent shall file and serve its response to the Petition within 21 days from the date hereof.
4. The Petitioner shall file and serve written submissions on the Petition within 14 days from the date of being served with the Respondent's repliy.
5. Thereafter, the Respondent shall file and serve written submissions in reply to those of the Petitioner within 14 days of being served.
6. The matter shall come up for highlighting of written submissions before me on 18/10/2024 at 09:30am EAT.
7. The Respondent's Counsel is further directed to ensure that all relevant departments and sections of the Respondent are made aware of this Consent Order.
