RULING
1. The application herein is dated 6/3/2026. The citation reads “IN THE ENVIRONMENT AND LAND COURT AT NAIROBI”. However, the Applicant mistakenly filed the matter in the High Court Judicial Review Division. That was in error and counsel for the applicant acknowledges that their clerk filed the matter in a wrong court.
2. In the premises, as this court cannot hear and determine a matter which ought to have been filed, heard and determined before the Environment and Land Court and by dint of Article 165(5) (b) of the Constitution, I decline jurisdiction and strike out the application dated 6/3/2026 with no orders as to costs.
