' 1. I have considered the Chamber Summons and the Notice of Motion, both dated 29th August 2025. Both have been brought under certificate of urgency. The Motion seeks to have the Plaintiff/Respondent deposit the security for costs. I note that the matter is due for hearing in late October before the Judge in Kwale.
2. So that the Motion may be considered and determined before the hearing date of the main suit, I direct that this application be heard interpartes on 16th September 2025 before the Hon Mr Justice Andayi. I direct that the application be served on the parties hereto within three days of the date hereof. I grant the parties leave to file skeleton submissions.
