1. The Applicant, Kunj Gupta , seeks a temporary variation of the conditions of bail granted to him to enable him to travel to the United Kingdom to attend to a family emergency involving his ailing parents.
2. The application was heard before me today. Mr. Anangwe appeared for the Applicant while Mr. Sirima appeared for the Respondents. The application was not opposed .
3. Having considered the application and the circumstances advanced in support thereof, I am satisfied that the orders sought are merited.
4. Accordingly, the application is allowed and I make the following orders:
a. Kunj Gupta , the Applicant, is permitted to travel to the United Kingdom for the purpose stated in the application.
b. The condition requiring the Applicant to surrender his passport in HCCRREV /E456/2025 is hereby temporarily varied .
c. The passport deposited with this Court shall be released to Kunj Gupta , the Applicant, THROUGH HIS ADVOCATE to facilitate the said travel.
d. The condition barring the Applicant from leaving the jurisdiction without leave of the Court is hereby varied to the extent necessary to permit the said travel.
e. The Applicant shall return the passport to this Court within seven (7) days of his return to Kenya . (B Y LATEST 16TH SEPTEMBER 2026
f. The Applicant shall return to Kenya and remain subject to all the other terms and conditions of his bail.
5. The matter shall be mentioned on 21st September 2026 to confirm the Applicant's return and for further directions .
6. All other terms and conditions of the Applicant's bail remain in force.
