1. I have perused the Notice of Motion dated 9th February 2026 , the supporting affidavit, as well as the annexures attached thereto.
2. The application seeks the stay of further proceedings in the matter before the court below pending the hearing of the appeal against the decision delivered by the Hon Kadhi on 7th January 2026 . I note that the impugned ruling was uploaded on the same day at 1047am . No cogent explanation has been given as to why the appellant/applicant waited until the very last minute to file the application. Under the circumstances, I am unable to exercise my discretion in her favour.
3. I order that the application be served upon the respondent within two working days for a hearing interpartes on 19th February 2026.
