KHADIJA KHATIOLI OKUTOYI VS JOHN MWANZI KENYATTA AND MOHAMMED MUSUNGU ONGOKHO AND 1 Others

Environment and Land Court at Kakamega Environment and Land Court · · Dalmas Ohungo

The issue that now arises for determination is whether the first defendant can be granted an adjournment to enable him call the Land Registrar and one other witness.

I have considered the application and the submissions. Following the ruling made earlier today when the court dismissed the first defendant’s application for adjournment, DW1 has now testified. The first defendant’s case is ongoing. The only way in which the Land Registrar and the other proposed witness can come in as the first defendant’s witnesses would be if an adjournment is granted to the first defendant. Yet the issue of adjournment was determined earlier today. No new or valid grounds have been advanced to warrant a departure from the earlier ruling. Application for adjournment is dismissed.

Dated 20th May 2024.
