(From the original conviction and sentence in Winam Senior Principal Magistrate’s Court Criminal Case No. E468 of 2022)
1. On 29th November 2022, the convict Kevin Anyera Olindo was sentenced to serve 3 years’ imprisonment for the offence of obtaining money by false pretences. The amount the complainant was defrauded was Kshs.190,000. The convict pleaded guilty to the charge. The complainant has the opportunity to sue for recovery of his money which is colossal.
2. The convict has served 2 years and has a balance of 1 year.
3. In the spirit of prison decongestion, and to allow the convict time to raise the complainant’s money for refund, I order the convict Kevin Anyera Olindo released from prison and not to reoffend for the next one year.
4. Unless otherwise lawfully held, he shall be set at liberty forthwith.
